ActionSA is very worried about the recent cases of vandalism and theft of our election posters in different parts of the Johannesburg Region. These acts of lawlessness not only break the Electoral Act but also go against the principles of democracy and fair campaigning.
We’ve noticed that some informal businesses have used our election posters on street poles for their own advertising, ignoring the outdoor by-laws that control such adverts. This is not okay and shows a lack of respect for the law and the democratic process.
ActionSA strongly believes in following the law and respecting local government rules. That’s why we’ve decided to open criminal cases against the suspects and those responsible for these crimes. We urge the authorities to act quickly to make sure those accountable face justice.
The Electoral Act has an Electoral Code of Conduct to encourage conditions for free and fair elections. Damaging, removing, or messing up posters of other parties is a criminal act that can lead to fines or up to 10 years in jail. Political parties breaking the Code can face serious consequences, like fines, losing election deposits, or even getting their registration cancelled.
We also want to remind businesses that they must follow the Outdoor Advertising By-law for the City of Johannesburg Metropolitan Municipality when advertising. Using election posters for business purposes without permission is not only against the law but also undermines the fairness of the election process and the city’s laws.
ActionSA believes that no country can succeed, and no economy can grow without the rule of law. Without it, there’s chaos, which damages society and stops economic progress.
We’re committed to following the principles of democracy and fair campaigning. We call on all parties and stakeholders to respect the law and make sure the upcoming elections on May 29, 2024, are free, fair, and transparent.
